If youre convicted of DUI twice within 10 years
Results in longer license revocation, mandatory treatment, and increased fines or jail time.
When convicted of a third DUI offense
Classified as a felony. Minimum 1-year jail term and long-term license revocation.
At the fourth DUI conviction
Felony charge with mandatory jail and extended license loss. Penalties increase sharply.
If a driver has seven DUI convictions
Lifetime license revocation and extended prison sentence. Delaware applies harsh penalties.
If a first offender chooses the FOE program
Allows avoiding court conviction by entering treatment and installing an ignition interlock device.
If youre under 21 and convicted of DUI
Subject to Zero Tolerance law. License revoked even if BAC is below 0.08%.
At the time of DUI conviction, you may be required to use a breathalyzer
Device must be installed in your car. Required before full license reinstatement.
If you attend court-ordered treatment for DUI
Completion is mandatory for reinstatement. Includes classes and evaluation.
